Anti-Discrimination Legislation
Under the Victorian
Equal Opportunity Act 1995, it is
unlawful to treat someone unfairly or harass
them because of their actual or assumed gender
identity. According to this Act, gender
identity is defined as self identification
as a person of the relevant gender. This covers
cross-dressers, people who are intersex, and
people who are transgender, and includes anyone
who has had, is undergoing or is planning to
undergo a gender reassignment. The Act
acknowledges that a person may identify as a
member of a particular gender by their style of
dress, medical intervention or by other means,
including a change of name.

Correction of Legal Sex
In Victoria, any person
- who is at least 18 years of age,
- is not married and
- has undergone sex affirmation
surgery
may make application for alteration of the
sex in the birth register or for the issue of a
Recognised Details Certificate.

While Victorian drivers licences
dont state legal sex, the motor vehicle
registry will change their records if provided
with a letter from a medical practitioner.
The legal sex designation on a Victorian
passport can be changed with a change of name
registration and a letter from a medical
practitioner.
