Anti-Discrimination Legislation —

The Queensland Discrimination Law Amendment Act 2002 protects transgender people and intersex people from discrimination in public places such as work.

The Anti-Discrimination Commission Queensland is an independent statutory authority which administers the QLD Anti-Discrimination Act 1991.

Change of Name —

Queensland Driver's License Corrections —

A Queensland driver's license has a sex designation (M or F) on the license. A person can change their sex designation on their driver's license with a letter from a psychiatrist supporting the sex designation to be shown on the license. This is sufficient for the Qld Dept. of Transport (Main Roads) to re-issue the license with the correct sex designation.

If the person's name on a Queensland driver's license needs to be changed at this point, the change of name registration document from the QLD Registry of Births, Deaths and Marriages is required.

Correction of Legal Sex —

The Queensland Discrimination Law Amendment Bill 2002 has amended the Queensland Births, Deaths and Marriages Act 1962 to allow post-operative transgender people (transsexuals) to obtain new birth certificates in their legal-sex.

In Queensland, a person can apply to have their change of legal-sex recorded if

  • they are 18 years or more,
  • have undergone sexual reassignment surgery, and
  • are not married.

The application must be accompanied by either statutory declarations by two doctors verifying that the person has undergone sexual reassignment surgery, or a recognition certificate for the person.
